Following the meeting of the Monitoring Committee for the Regeneration of Portman Bay, and whenever the plot itself does not have explicit commitments to the start of works under the pretext that we must make a legal opinion to determine whether the Royal Decree 975/2009 of June 12 should apply to the regeneration project, in existence since July 2008, IU of the Union as:
1. That we are facing a very crude and unsophisticated delaying tactic, since the Decree, Second Transitional Dsposición explicitly states that the records being processed at the time of the adoption of the decree (June 12) are not affected by it, but by the previous legislation. But it is more: Article 13 of the Decree, which establishes measures for the rehabilitation of areas affected by natural exploitation of mineral resources, is well below the requirements set out in the regeneration project. Finally, if this report was mandatory, it could be made from June 2009, when he came into effect the decree would interfere with the project reportedly drafted a year earlier, in June 2008.
2.
